我最近遇到了一件事, 在我應聘新的工作的時候, 他們給我Offer上寫的是3 weeks vacation to start, 然後我就發郵件問,3個星期的假期,是否可以從第一年開始( can I use the vacation for the first year), they said yes, and then I send out another follow up email to ask could I use it for my probation period, they said yes.

昨天我去添休假單的時候,　我添的是vacation, 但是他們告訴我不對,　是Unpaid.因為我這星期就出發,　機票和一切事情我都安排好了,　我已經沒有時間改變行程了。

請大家幫忙分析一下,　這時候雙方的理解有誤差,　還是怎麼回事,這是正常的嗎?

Depends on how long you have been worked there? Have you accrued enough days to cover your vacation? The company may won't willing to take risk to pay you but not coming back.

I worked there for 2 months, but the thing is we already discussed before I accept the offer,they told me yes, that is one conditin that I consider the offer.

我的理解可能有錯。但是,最基本的休假流程是你先申請,老板批了,你再去安排機票什麼的。

很多公司vacation都是prorated,按工作時間分攤,但可以借。

不管你休多久,只要雇主給你相當於4%薪水的錢就可以,Unpaid和Paid不重要,反正你拿到的最多是4%

You only accrued for 2.5 days then. Have you confirmed with specific dates and confirmed that you still want to be on regular payroll? If yes, then they should do differently.

No, 15days annual means 6%.

你開始上班了嗎?如果還沒有就不算probation period,如果你已經開始上班,不管是不是在三個月試用期內提出,都要付給你,他們的意思是第一年就給你三個星期的VACATION ,一般是要工作5年才有三個星期的VACATION。

最低4%,如果有和約除外,就算6%,只要給夠6%就可以,Paid or Unpaid不重要
